YouTuber MrBeast sued over top chocolate bar as rival company says star is tarnishing product named after late relative

Chocolate bar company MRBEAST has been sued over the name of one of its products.

According to the Daily Dot, the lawsuit alleges that one of MrBeast’s Feastable flavors caused confusion and tarnished the brand, which was named after the founder’s grandmother.

Florida-based Dee’s Nuts has sued Feastable’s for its Deez Nutz candy bar, alleging trademark infringement, in a lawsuit filed Aug. 25.

Feastable’s Deez Nutz is a chocolate peanut butter bar sold by the candy company.

Brian Ditore, the owner of Dee’s Nuts, has claimed that the similarity in names caused hostilities and a drop in sales.

Ditore claimed that the trademark for “Dee’s Nuts” was registered on September 25, 2012.

According to the US Patent and Trademark Office, Ditore filed the name on June 15, 2011, according to the Daily Dot.

The lawsuit alleged that Dee’s Nuts received messages from people online accusing them of stealing MrBeast’s copyrights.

Dee’s Nuts also claimed that searches for their product on retailer Walmart’s website returned results for Feastables’ Deez Nutz bars.

Ditore claimed that they started selling their products on the Walmart website in June 2023, but when they searched “deesnuts” in the website’s search bar, they only saw Deez Nutz results.

Dee’s Nuts has also claimed that they spent thousands of dollars on marketing and established their brand through a “grassroots marketing” campaign.

According to the lawsuit, “Plaintiff has consistently used the DEE’S NUTS trademark commercially for the sale of gourmet-flavored peanuts for over a decade.”

Dee’s Nuts has also claimed that the company makes millions of dollars annually by being a “leader in selling processed nuts.”

The lawsuit also alleged that Dee’s Nuts is expected to have sales of between $5 million and $5 million in 2023.

Ditore cited that his company was named after his grandmother, Adeline D’amore, who was known as Mrs. Dee, and claimed Deez Nutz was tarnishing that reputation.

The lawsuit said, “Her laughter and belief that life should not be taken too seriously were inspired.” [Ditore] to choose a trademark that pays homage to her and her comedic talent.

“That’s where DEE’S NUTS came from.”

MrBeast announced the Deez Nutz variant of Feastables in X, officially known as Twitter. post on February 14th.

According to the Daily Dot, Dee’s Nuts claim they sent MrBeast’s Feastables a cease and desist order after the video was released.

Feastables reportedly told Dee’s Nuts in April that they would continue to use Deez Nutz.

Dee’s Nuts has sought damages from the court for feastables and attorneys’ fees.
