When will the Illinois Purge Act go into effect and what will happen?

A new law that will abolish cash bail in the state of Illinois has divided opinion, with some describing it as a “massive threat” to public safety.

The SAFE-T Act (Safety, Accountability, Fairness and Equity-Today) was signed into law by Governor JB Pritzker in 2021.

When will the Illinois “cleanse” law go into effect?

The so-called “purge” law will come into force on January 1, 2023.

Parts of the SAFE-T Act legislation are already in place, while other parts will be phased in over the next few years – including the Purge Act.

What happens when the law goes into effect?

The far-reaching, nationwide judicial reform law will, among other things, end cash bail.

The SAFE-T Act will eliminate cash bail to address the injustice of poor people who remain in detention while those who can afford bail are released.

Governor Pritzker said he believes this bill will reform the criminal justice system.

“Transform the pre-trial detention system so that low-income people are not thrown behind bars, while only the rich roam free, low-level drug offenses are diverted into drug treatment programs, and excessive incarceration is reduced.”

Legal experts have refuted claims that cash bail means the immediate release of pre-trial detainees charged with crimes including second-degree murder, aggravated assault and arson, and that the decision will still rest with the judge.

Illinois prosecutor J Hanley claimed 400 suspects would be released under the law.

“The law will allow dangerous individuals to roam our streets. It will deter victims and witnesses from reporting crimes.

“And it’s going to make those alleged crimes harder to prosecute,” Hanley said.

Meanwhile, proponents of the law are hailing the grand act of criminal justice reform.

What does clean mean?

Rumors about the law abounded on TikTok, as users incited fear by comparing it to the 2013 horror film The Purge and claiming the state had gone into a “purge mode.”

In the film, all crimes, including murder, are legal for a 12-hour period.

One person said, “America is becoming Gotham City #ThePurge.”
