RAPPER Gunna has been released from jail after reportedly taking an Alford plea.
The rapper, whose real name is Sergio Kitchens, pleaded guilty to gang racketeering charges after standing before an Atlanta state judge on December 14, 2022.
What is the Alford Plea?
An Alford plea allows a defendant to plead guilty while maintaining his innocence and not admitting to the crime of which he is accused.
During her pleading, a defendant concedes that there is sufficient evidence to convict her in court, but in the circumstances chooses to be treated as guilty and proceed to sentencing.
The pleading takes its name from the 1970 case of North Carolina v. Alford, in which defendant Henry Alford pleaded guilty to second-degree murder to avoid the death penalty for the crime he was originally charged with — first-degree murder.
At the time, Alford argued his plea was “involuntary because his primary motivation was fear of the death penalty.”
A long series of cases followed, leading to a landmark ruling by the Supreme Court.
It states: “A person accused of a crime may voluntarily, knowingly and understandingly consent to the imposition of a sentence of imprisonment even if he is unwilling or unable to admit his involvement in the crime”.
