A FAMILY can’t sell their house after finding out they don’t own a corner of the living room and part of the garden.

Linda Hoffman, 73, has been trying to sell her home for two years, but when a buyer finally showed up, it turns out they didn’t own parts of the property.

She and her husband bought the land from neighbors in 2000 and built a house three years later.

When Linda’s husband died in April 2020, she and her son Bryn Hoffman decided to list the house when they found somewhere to live close to his home in Gedling, Nottinghamshire.

Bryn said: “A bungalow came up and it was stunning, perfect location and just around the corner from me.

“We put the house on the market and found a buyer and everything went through.”

But lawyers for a potential new owner discovered part of the section doesn’t belong to the family it wants to sell.

He said: “It emerged through their solicitors that there is a part of the land that does not belong to my parents, which is the bank next to the road, the footpath down the side of the house down to the bridge and at the very edge of the house, in the Basically the corner of the living room.”

The family believe the market value for the disputed 400 square meter plot of land is around £1,000, the Nottingham Post reported.

Bryn added: “It was just shocking and an abysmal experience.

“There is no reason why this could not be resolved beforehand.”

Linda says the whole ordeal was extremely frustrating and she’s just about to get over it.

The family had no idea who owned the land after their request for prejudicial ownership was denied.

She said: “Luckily I’m a strong person but it’s just exhausting. I rang in land registry day for a month and every time I spoke to someone I got a different story.”

A spokesman for His Majesty’s Land Registry has since said that there has been a high number of real estate transactions in 2021-22, leading to an increase in processing times.

They said: “We previously apologized to Ms Hoffman and have no hesitation in repeating that apology.

“HMLR cannot process an application until it has completed the relevant legal formalities. Unfortunately, the initial delays were compounded by deficiencies in the applications originally submitted on Ms. Hoffman’s behalf. This meant we had to cancel some of the requests and request replacements.

“The replacement applications have since been submitted and reviewed by HMLR. Ms. Hoffman’s motions concern possession of adverse tenure, which is a highly technical area of ​​law. Consequently, once the applications are in order, HMLR is bound by certain statutory deadlines.

“We cannot deviate from that. We also received an objection to one of the applications.

“If we receive such an objection, we cannot complete the application until the dispute is resolved.”

It comes as a homeowner spoke from hell about not being able to sell her house since her neighbor owns half of her bedroom.
