TREVOR Bauer’s accuser can be seen in video provided to the court by his legal team “smiling in bed with the LA Dodgers star” – which he says is proof he never attacked her.
The pitcher has moved to dismiss a counterclaim against a San Diego woman known as Ms. Hill in his defamation lawsuit after she accused him of violent sexual assault.
Prosecutors decided last summer not to press charges against Bauer, and her request for a restraining order was denied by an LA judge.
In April, Bauer’s legal team filed a defamation lawsuit against Ms Hill and her attorney, Niranjan Fred Thiagarajah, for “knowingly making false statements”.
She has since filed a counterclaim for sexual harassment and assault, alleging that Bauer’s defamation allegations were an attempt to silence and intimidate her.
But he is now filing to dismiss their counterclaim and has produced new alleged evidence in the form of never-before-seen video of them in bed together.
The clip lasts just nine seconds and has no sound, but reportedly shows Ms Hill smiling and shows Bauer sleeping next to her wearing a black eye mask.
His attorneys allege in court filings that the video was obtained by the Pasadena Police Department and was recorded at Bauer’s home after he allegedly injured her during sex on May 16, 2021.
His team wrote in the filing: “She appears willingly in bed with a sleeping Mr. Bauer and is grinning and unharmed.”
It is not known why the photo was never used during her restraining order trial and why police did not respond to a request for comment.
The US Sun also contacted Ms Hill’s attorney but received no response.
In the motion to dismiss, Bauer’s team claimed that as a judge, they had already determined that the two encounters were amicable during their restraining order hearing, so they could not counterclaim.
They also allege that she did not seek permission from the court to file an additional response and that she was outside the allowed time frame.
Ms Hill alleges the 31-year-old sports star hit her twice during sex and choked her until she was unconscious in April and May 2021, according to court documents.
She also claims in the files that the MLB pitcher entered her without her consent.
Referring to the night before the new video was allegedly taken, Ms Hill previously told the court: “I had terrible pain behind both of my ears. I tasted blood in my mouth and felt my lip split.
“When I was finally able to speak, I said to him, ‘I think my body has a trauma reaction.’
“He helped me into the shower to rinse me off as I was physically unable to go to the shower on my own.
“I was extremely anxious and scared for the rest of the night but still felt extremely disoriented and in significant pain.”
She claimed that during the restraining order hearing she was “focused on leaving” and “just wanting to get out of his house.”
Ms Hill claimed: “I got out of bed at 8:30am while he was still asleep.
After Ms. Hill’s restraining order was denied, Judge Gould-Saltman noted that in her communications with Bauer she “was not ambiguous that she wanted rough sex the first time the parties met and rough sex the second time they met.”
The judge noted, “In this case, the court finds that there is no supporting evidence that Bauer would harm her or even have contact with her.”
She decided that “beatings, black eyes, and hospitalizations” were consequences of the acts she had consented to.
However, Judge Gould-Saltman described photos released of her battered face as “terrifying”.
Ms Hill later claimed in the latest court documents that her “life was turned into a nightmare by a powerful man who beat her mercilessly, expecting no consequences for his despicable behavior”.
She claims she suffered “physical injuries, severe emotional distress, [and] Humiliation” due to Bauer’s sexual battery.
Bauer was suspended from MLB for two years after they found he violated the league’s policies on sexual assault and domestic violence.
He is in the process of appealing, but a decision will not be made until after the World Series in November.
A hearing in Bauer’s defamation case is now scheduled for November 21, 2023 in Santa Ana, California.
