REAL Housewives of Beverly Hills’ Erika Jayne has been slapped with a new $2.2 million tax bill she can’t pay — but she’s refusing to give up her $40,000-a-month glam squad.

The under-fire star is being asked to hand over a $1.4million pair of diamond earrings from her ex Tom Girardi in a bankruptcy lawsuit filed by a trustee for his law firm.

But Erika claims she’s struggling financially and may have to give it up to pay back taxes as she’s been dealt another hit with her latest bill.

She already owes $2,519,882.40 for the years 2011-2013 for her company EJ Global, which is currently on suspension, according to a Franchise Tax Board letter viewed by The Sun.

In a statement Filed Tuesday night, she claimed her director received another income tax due bill from the California Franchise Tax Board in late May this year dated May 10, 2022, stating that she owed $2,226,985.77 in 2019 taxes .

“I am in the process of figuring out the basis of this tax bill with the help of my manager who is also an accountant,” she wrote. “I am unable to pay the FTB tax bill.

“I also don’t know if the FTB is taking any lien on my assets, which include the diamond earrings.”

Attorney Ronald Richards, representing Chapter 7 trustee Elissa Miller, told The Sun: “She says she just received the FTB tax bill in May 2022. Of course, as EJ updates EJ Global and files returns, this will increase her statement that she has personally attended an audit for previous years.”

Despite her financial woes, Erika claimed on a recent episode of RHOBH that she won’t let her $40-month glam team go, explaining that there are “certain things you don’t downsize.”

However, in court documents, she claims her only assets are her personal belongings, including jewelry, and her income from the reality TV show Real Housewives of Beverly Hills.

She wrote: “I also have various sponsorship earnings related to performances or product endorsements. Also, for the past year, I’ve been trying to start a business related to hair extensions.”

Court records show that Tom Erika, 50, bought the earrings as a gift around 2004 or 2005, but they were stolen about a year later.

FIGHT FOR JEWELS

She claims her family’s home was searched one night as they went out to dinner and she left the earrings in a crystal container in her bathroom.

The earrings, which were reportedly bought by M&M jewelers for $750,000, are now worth about $1.4 million.

Erika claims the earrings were stolen and uninsured, so Tom replaced them with a replica pair, adding, “I had no reason to doubt or question the source of the funds used to purchase the earrings.”

She said in late 2021 or earlier this year she first heard from the trustee in the bankruptcy proceedings for Tom’s law firm, Girardi Keese, who allegedly were the earrings Bought with money from a customer escrow account.

“I have always been willing to put the earrings in escrow until a final court order is issued as to who is entitled to the earrings,” Erika continues.

“Indeed, by agreement with the trustee, the earrings are currently being held in a locker that the trustee has access to.

“I agree that the earrings may be stored in the locker pending a final court determination of ownership of the earrings.”

A previous court filing alleged that Tom hid the theft from the client’s trust by describing “the purpose of the review” as a “cost” item in relation to one of his previous lawsuits.

THE LEGAL DRAMA OF THE EX

The document read: “Erika has no legal or equitable right to the diamond earrings and they are legally and equitably valuable assets of the GK bankruptcy estate which the trustee can and should sell.”

During a previous episode of Real Housewives, Erika, who is filing for divorce after more than 20 years with Tom, claimed she currently has “zero dollars” in her name.

Speaking to Kyle Richards, she said: “I’m out here rebuilding my life but girl I’ve got zero dollars.

“And until those trustees are done with him [Tom]there will be nothing.

“So I’m walking away with nothing.”

Erika continued: “And that’s what I said to my lawyers the other day.

“I said, ‘I don’t expect anything.’

“And one of my lawyers looked at me and said, ‘That’s the bravest thing I’ve ever heard.’

“Every day brings a brand new disaster. It’s just full of fucking cops.”

Tom and his law firm Girardi Keese were previously accused of embezzling funds from several families who lost loved ones in a 2018 Boeing plane crash.

The 83-year-old was later sued by his business partners, leading to a Chapter 7 bankruptcy filing in December.

Despite claiming ignorance of Tom’s wrongdoing, the Bravo star finds herself at the center of the legal drama.
