CHICAGO – A Cook County grand jury on Thursday found former “Empire” actor Jussie Smollett guilty of five of six counts of disorderly conduct.
The jury found Smollett guilty on counts 1-5 and not guilty on counts of six. 12 jurors came to the verdict after more than 9 hours of deliberation.
Smollett will appear in court on Thursday, January 27.
Since Smollett has no criminal history, it is highly unlikely that he will be sentenced to prison any time soon.
The trial was marked by allegations of perjury by prosecutors and defense attorneys.
Dan Webb, who is leading the special prosecution, bluntly called Smollett a liar during the debate that ended Wednesday morning.
“Mr. Smollett stood in that witness stand, swearing that he would tell the truth [and] He made a lot of false claims to you,” Webb said. “He swore an oath to you as juror.”
Nenye Uche countered that the prosecution’s star witnesses, Olabinjo and Ambola Osundairo, lied when they testified that Smollett recruited them to participate in a fake hate crime.
“They are certified liars,” Uche said of the Osundairo brothers. “They lied to this court, they lied to this jury.”
In the early hours of January 29, 2019, Smollett informed police that he was the victim of a racist attack near his Streeterville apartment. Smollett told police he was targeted by two men shouting curses while one punched him in the face and another smeared bleach on him and a rope around his neck. ta.
The reported attack quickly gained international media attention, although it also served as fodder for comedians and late-night TV presenters.
Just weeks after he reported the assault to police, prosecutors approved charges of disruptive behavior against Smollett.
Former CPD Supt. Eddie Johnson lamented to Smollett, telling reporters: “How could someone so well received by the city of Chicago go back and slap everyone in the face in this city by making false statements. this?”
However, the charges against Smollett were quickly dropped in late March, angering Chicago leaders. Former Mayor Rahm Emanuel called the decision “a fallacy of justice.”
Cook County Judge Michael Toomin in June 2019 found that irregularities in the case required a special prosecutor. Toomin appointed Webb as special prosecutor in the case in August 2019.
A year later, Webb found the state attorney’s office “abuses of self-determination,” although the specifics of his investigation remain sealed.
Webb brought new charges against Smollett in February 2021.
And even though the criminal trial has ended, the Smollett saga will continue to play out in at least two other civil cases.
The city filed a lawsuit against Smollett in April 2019, seeking to recover approximately $130,000 in overtime payments to CPD investigators who reviewed Smollett’s original assault complaint. .
That same month, the Osundairo brothers filed a lawsuit against former Smollett attorney Mark Geragos and current Smollett attorney Tina Glandian.
The brothers allege that the two attorneys made a number of defamatory statements. Both lawsuits are still pending in federal court in Chicago.
