JUSSIE Smollett could be freed after an appeals court sided with his lawyers, who say he should be released during the appeals process.
A judge ordered him to be freed as his lawyers appealed guilty to lying to Chicago police about a racist and homophobic attack in 2019.
The decision comes after a Cook County judge sentenced Smollett last week to immediately begin 150 days in prison for being convicted of five felony counts of disorderly conduct.
The order came unexpectedly and was contingent on him signing a $150,000 personal recognition bond.
In an outburst shortly after the sentence was pronounced, former Empire actor “I did not commit suicide. And if anything happened to me when I got in there, I wouldn’t have done it to myself. And you all must know that.”
In decision 2-1, the appellate court said Smollett can be released after posting a post, a $150,000 personal recognition tie-up, according to the Associated Press.
This means Smollett did not have to put money but agreed to go to court as required.
