A Wisconsin judge on Friday approved the attorneys’ agreement to destroy the assault-style rifle Kyle Rittenhouse used to shoot three people during a 2020 street protest.
Assistant District Attorney Thomas Binger said the state crime lab will destroy the gun, possibly in April. Judge Bruce Schroeder, the Kenosha County judge who presided over the Rittenhouse trial, approved the settlement. Rittenhouse did not appear in court during Friday’s hearing.
Rittenhouse shot these people during a protest in Kenosha in 2020. He killed Anthony Huber and Joseph Rosenbaum and wounded Gaige Grosskreutz in the arm. Rittenhouse argued that he opened fire in self-defense after each of the men attacked him. Last year, a jury acquitted him of multiple charges, including murder.
Rittenhouse’s attorney, Mark Richards, filed Jan. 19 asking prosecutors to return Rittenhouse’s rifle, ammunition, a mask and other clothing he was wearing on the night of the shooting for him. Richards and David Hancock, spokesman for Rittenhouse, said last week that Rittenhouse, 19, wanted to destroy the rifle and throw the rest away so nothing could be used as a political symbol. or the commemoration of the shooting.
The rest of the Rittenhouse estate was returned to him, Binger told the judge.
Conservatives nationwide have praised Rittenhouse, saying he has protected Kenosha from far-left gunmen. Liberals painted him as a happy vigilante.
Meanwhile, another legal battle is raging over the fate of the $2 million conservatives raised to bail Rittenhouse. Richards filed a petition Thursday seeking the money, with plans to split it between his law firm and the #FightBack Foundation. Attorneys Lin Wood and John Pierce, who represented Rittenhouse in the early days of the case, formed the foundation to raise money for him.
Richards also wants to return $150,000 to actor Ricky Schroder, who donated to protect Rittenhouse.
The Trademark and Patent Defense Fund also filed a petition on Thursday, making a claim for $2 million. The trust’s attorneys argued that as Pierce’s creditors, they deserved all the money.
Protesters took to the streets for several nights in Kenosha in August 2020 after a white police officer shot Jacob Blake, a Black man, from behind when Blake resisted arrest during a disturbance mix in water. The shooting left Blake paralyzed from the waist down.
Protests have sometimes turned chaotic, with people burning buildings. Rittenhouse and his friend, Dominick Black, joined a group of militia members to protect a batch of used cars on the night of August 25, 2020.
Rittenhouse, then 17 years old and living in Antioch, Illinois, was armed with an AR-15-style rifle that Black bought him earlier that year because he was too young to buy a gun under Wisconsin law.
By motion, Black has agreed that the rifle will become the property of Rittenhouse on his 18th birthday, January 3, 2021.
Bystanders and surveillance video showed that shortly before midnight, Rosenbaum chased Rittenhouse and Rittenhouse shot him as he approached him. He shot Huber after Huber swung his skateboard at him and Grosskreutz after Grosskreutz ran up to him holding a pistol. Everyone involved in the shooting was white.
Black did not object to two citations earlier this month for contributing to delinquency by a minor in exchange for prosecutors dropping two counts of knowingly selling a dangerous weapon to a person under 18. age.
