EL PASO, Texas (KTSM) – The mask ban is back in effect after a federal appeals court restored Governor Greg Abbott’s executive order banning face masks in schools across Texas.
The 5th Circuit Court of Appeals ruled after Texas Attorney General Ken Paxton challenged an earlier decision by a court in Austin, Texas to allow schools to impose mask-wearing mandates.
The three-judge panel said it found no “specific, or actual, or imminent injury” due to Abbott’s ban on masking duties.
Abbott has also previously banned vaccine missions in the Lone Star state.

Governor Greg Abbott today issue an Executive Order prohibits government entities in Texas – including counties, cities, school districts, public health agencies, or government officials – from requiring or mandating the wearing of masks. Public schools can continue to follow current guidelines for wearing masks through June 4. After June 4, no students, teachers, parents or other staff or visitors Guests may be required to wear a mask while on campus.
Beginning May 21, local governments or officials that attempt to impose a mask mandate or impose a limit that is inconsistent or inconsistent with the Executive Order may be subject to fines of up to $1,000.
“The Lone Star State continues to defeat COVID-19 through the use of vaccines, antibody treatments, and safe practices used by Texans in our community,” said Governor Abbott. “Texans, not the government, should decide on their health best practices, which is why masks will not be mandated by school districts or government agencies. We can continue to mitigate COVID-19 while protecting the freedom of Texans to choose whether or not to cover up.”
Exempt from the Executive Order are state-supported living centers, government-owned or operated hospitals, Texas Department of Criminal Justice facilities, and Department of Justice facilities. Texas juveniles, county and city prisons.
