Family with 1-year-old getting punched in the face at Butler Memorial Hospital Sues Health System – CBS Pittsburgh

BUTLER, Pa. (KDKA) – The family of a 1-year-old who was punched at Butler Memorial Hospital is suing the health system.
Miller’s family claims no one helped them when Elijah Flick-Geibel attacked mother and daughter. The baby was punched in the face as his mother, Kelly Miller, tried to protect him.

Sympathizing with the fact that Flick-Geibel was dealing with mental health issues, the family dropped more serious assault charges against him.
The lawsuit alleges that the hospital failed to protect them.
“There was a time when this could have been stopped,” Kelly said.
The Millers have now retained Butler County attorney Alexander Lindsay.
“This particular action is an allegation of negligence by the hospital,” Lindsay said.

The complaint says that when Kelly yelled for help in the emergency room, no one came to help her until hospital staff, not security, subdued Flick-Geibel.
“I just feel like the hospital can take precautions in this situation. They can 100% prevent this from happening,” Kelly said.
Her husband Jermaine agreed: “Sure they can, they’re definitely close enough already.”
Kelly said she and her baby are still recovering from the attack, but traumatized.
“He’s definitely still going through some issues from this,” she said.
Lindsay said Kelly carried more luggage than her son.

KDKA has reached out to Butler Memorial Hospital for comment but has not received a response.
