‘Cult Mom’ Lori Vallow makes a brazen plea, claiming her rights were violated when she faces trial for murdering her children

LORI Vallow’s defense team has brazenly asked for her trial to be thrown out in a shocking motion that argues the cult mother’s constitutional rights have been ignored.
Lori and her husband Chad Daybell are on trial for the murders of their children JJ, seven, and Tylee Ryan, 16.

Her team made the bold demand after advising the court that she will be in jail for 1,169 days before the trial begins.
“It is undisputed that Lori Vallow Daybell called for her expeditious trial and never waived her constitutional rights,” defense attorney Jim Archibald wrote in a filing Thursday.
“She’s biased every day since she’s in jail and unable to post bail.
“The court has repeatedly reminded the government that it will respect its constitutional right to a speedy trial.”


Lori and Chad have been charged with the murders of JJ and Tylee and will appear in court in April, where they face the death penalty if convicted.
Lori’s family members have accused her of being part of a “doomsday cult” with her fifth husband.
She was arrested in February 2020 in Hawaii, where she was enjoying a fabulous tropical vacation while her children went missing.
Lori was extradited to Madison County and sent to prison.
The mother was charged with murder by a grand jury in May 2021, but her trial was postponed due to her questionable competence.
However, the judge ruled in late 2022 that she was fit to stand trial.
“A 40-day delay caused by the competency review still does not warrant a trial three years after her arrest and nearly a year after her arraignment,” Archibald wrote, per the East Idaho News.
“The government still has an obligation to bring them to a speedy trial consistent with the Constitutions and the Idaho Code.”
Lori’s team angrily urges the court to move on while her husband, Chad Daybell, waives his right to a speedy trial.
During a Jan. 19 court hearing, District Judge Steven Boyce denied a request by Chad’s attorney to delay the trial until April 2024.
Boyce also turned down a request from Lori’s attorneys to meet with her and Chad to strategize the case.
Lori’s attorneys are now arguing in this latest motion that the court should drop charges against her over the messy start date.
“The government cannot establish ‘good cause’ to try Lori Vallow Daybell more than three years after her arrest and nearly a year after her indictment,” writes Archibald.
“This court should find that the government has failed in its duty to uphold its constitutional rights. This case should be dismissed.”
The grandparents of the children who were killed recently broke their silence about the postponed justice.
“I feel like the world is praying that this process moves forward and that we have a good, honest, direct process that focuses on the evidence,” Larry Woodcock, grandparents of JJ, told East Idaho News on Thursday.
“I believe this case will be proven beyond a reasonable doubt,” Larry said.
“They can make any excuses, but in the end they are guilty of murdering two children.”
JJ AND TYLEE DISAPPEAR
JJ and Tylee disappeared in September 2019 but were not reported missing until months later.
JJ was enrolled at Kennedy Elementary School on September 3, 2019, but was “dropped out” nearly three weeks later after Lori claimed she was homeschooling him.
Tylee was last seen on September 8 at Yellowstone Park on a family day out with her mother and uncle Alex Cox.
Lori originally told police that her children were staying with a family friend in Arizona when police conducted a welfare check at the family’s Rexburg home on Nov. 26.
Detectives later determined she had lied, noting that Chad and Lori had “abruptly evacuated their house” when police returned to question them the next day.
The couple reportedly told People that Tylee was dead and claimed she had no other younger children, although she had an older son, Colby.
In February, surveillance footage unearthed appeared to show Lori dumping children’s items in a warehouse the year before, around the time she and Chad fled to Hawaii.
Idaho authorities say there is no sign JJ and Tylee Ryan ever made it to Hawaii.
The “charred remains” of Lori’s children were then found wrapped in plastic bags in a pet cemetery on her husband Chad’s property, a court heard.
Investigators made the grisly discovery at Chad’s home on June 9, 2020.
Lori’s team also prepared two subpoenas for The Church of Jesus Christ of Latter-day Saints and for Carrie Reed of the Laurens Institute for Education.
The church was asked to provide “all church records, including attendance records, temple records, disciplinary records, performance records, or other records” related to Daybell.
And the team requested that the school provide “all school records, including attendance records, disciplinary records, transcripts of records, or any other records in your possession or control that may relate to Joshua Jaxon Vallow.”


The next hearing in Lori’s case is scheduled for February 9th.
Both Lori and Chad have pleaded not guilty to all charges.
